AND CORRECTIVE RE-SERVICE

TO ALL PARTIES AND THEIR ATTORNEYS OF RECORD:

PLEASE TAKE NOTICE that Petitioner John De Herrera hereby advises the Court of the following

regarding service of the Verified First Amended Petition for Peremptory Writ of Mandate and

Complaint, originally mailed by certified mail to counsel for Respondent on July 28, 2026:

DECLARATION OF JOHN DE HERRERA

I, John De Herrera, declare as follows:

1. United States Postal Service tracking records confirm the certified mailing was signed for at the

offices of Pacific Law Partners, LLP on July 29, 2026.

2. On August 12, 2026, Petitioner discovered, in his own post office box, a torn and separately re-

bagged item bearing a standard United States Postal Service damage notice. The contents of that

item, identified by Petitioner through a distinctive physical marking, are the complete Verified First

Amended Petition and Proof of Service originally mailed to Respondent’s counsel on July 28, 2026.

3. On August 12, 2026, Petitioner left a voicemail message for Respondent’s counsel, Matthew F.

Batezel, inquiring whether the certified mailing had been received complete and intact. On August

13, 2026, Petitioner sent a written email inquiry to the same effect. As of the date of this filing,

Petitioner has received no response to either inquiry.

4. Out of an abundance of caution, and to ensure Respondent has been properly and completely

served, Petitioner is this date re-serving the complete Verified First Amended Petition and all exhibits

by certified mail upon Respondent’s counsel, together with a new Proof of Service to be filed with

this Court promptly upon completion of that mailing.
